Just a ruff draft, but here's kind of what I want to say: (send via
email & also certified/return receipt/whatever snail mail:
==================================================================
You have not responded to my previous two e-mails requesting an
update on the status of my order. I am very concerned.
I would really like our transaction to be a win-win situation. You
win by earning money for your work, and you win by having a satisfied
customer who wears your product proudly & graciously refers people
to your business when they ask where the clothing came from. Word-of-
mouth advertising is the best marketing you can have, and it is
priceless!
I win by having custom quality clothing made of my favorite fabric,
obtained at a very reasonable cost. I win by having a satisfactory
business relationship with an accomplished artist I can trust for my
future costuming needs.
I am an honest person. I enjoy creating and maintaining a positive
environment in my life. I do not enjoy confrontations. It goes
against my grain to have to be confrontational or unpleasant to
people.
But, I don't like to lose, especially after taking such heavy
financial losses at the end of 2001. I will not tolerate being robbed
of $____ with a smile on my face.
I am prepared to talk to my friends and acquaintances who attend
renaissance faires and other 'garbed' events from coast-to-coast and
warn them not to order from you. I am prepared to post the entire
contents of our correspondence to every mailing list, web group, news
group, etc. I can think of in addition to my personal web page. I am
prepared to lodge complaints with the Better Business Bureau in your
area. I am prepared to contact PayPal regarding my payment of $------
for no product in return. I am also prepared to consult an attorney
friend to discuss the possibility of a small-claims court trial.
I do not want to be unpleasant. I do not want to hurt you or your
business. But I am not willing to just walk away from the money I've
paid you and the agreement we have made in good faith. Since your
store policy does not allow for cash refunds, I must insist that the
items I ordered be delivered to me ASAP.
Here is what I need from you in order to avert the unpleasant course
of action I am unhappily contemplating:
1. Email or postal mail ASAP regarding the status of my order: where
are you in the process of making the items I have ordered, and when
do you expect to ship the items?
2. The items arriving safely at my door in a timely fashion following
your email.
If you cannot complete items 1 and 2, I must insist that you refund
the money I have paid to you immediately, despite your posted store
policy. A PayPal payment in the amount of $_____ to the account of
------- will be acceptable.
I am very sorry for the tone of this note; it distresses me to have
to be unpleasant to you. But since you have not seen fit to respond
to my last two politely-worded notes, I feel I must adopt a stronger
tone. If I do not have a reply from you by January 31, 2002, I will
begin to take the steps I outlined above. If I do not have product or
refund from you by March 1, 2002, I will complete the steps outlined
above, up to and including small claims court if my attorney deems it
practical and appropriate.
I sincerely hope it does not come to that extreme. Please honor your
committment to me and allow us to have a win-win conclusion to our
business transaction.
